Stand-Up Paddleboard Rental Agreement & Liability Waiver

Please read this agreement carefully before renting a stand-up paddleboard (SUP) at the Witch Paddle event. By submitting this form, you acknowledge that you have read, understood, and agree to all terms and conditions set forth below.

1. EVENT REGISTRATION REQUIREMENT
SUP rental equipment is available exclusively to registered Witch Paddle participants. By completing this waiver, you confirm that you are a current, registered participant in the Witch Paddle event. Rental of equipment by non-registered individuals is not permitted. Misrepresentation of registration status voids all protections and agreements under this waiver and may result in immediate forfeiture of the rental.
2. RENTAL EQUIPMENT
The following equipment is being loaned to you for use during the Witch Paddle event. All items are the property of Hala Gear and must be returned in the same condition as received:
Stand-Up Paddleboard (Hala Gear)
Paddle
Personal Flotation Device (PFD / Life Jacket)
Leash
3. EQUIPMENT DAMAGE & LOSS LIABILITY
By accepting rental equipment, you agree to the following:

Board Damage: You are fully responsible for any damage to the rental paddleboard sustained during your rental period. This includes, but is not limited to, dings, cracks, delamination, fin damage, or any other damage caused by misuse, negligence, or accident. You agree to pay the full cost of repair, or if the board is deemed irreparable, the full replacement cost.

Loss or Damage of Accessories: You are financially responsible for the loss, theft, or damage of any accessories issued with your board, including the paddle, personal flotation device (life jacket), and leash. Replacement costs will be assessed at current retail value. Keep all accessories secured to your person or board at all times.
4. BOARD DECORATION POLICY
Rental boards may NOT be decorated, painted, taped, glued, marked, or altered in any way. While the Witch Paddle may feature a board decorating contest, this applies exclusively to personally owned boards. Any damage to rental boards resulting from attempted decoration — including adhesive residue, tape marks, or structural damage — will be treated as damage under the terms of this agreement, and you will be held financially liable for all repair or cleaning costs.
5. RESPONSIBILITY FOR MINORS & OTHER PASSENGERS
You assume full responsibility for any minor children or other individuals who ride on, are transported by, or otherwise use the rental paddleboard during your rental period. You acknowledge that:
The decision to allow a minor or additional passenger on the rental board is made entirely at your own discretion and risk.
You are solely responsible for the safety and supervision of any minor in your care at all times while on or near the water.
All minors must wear a properly fitted PFD at all times on the water, in accordance with applicable law.
You will be held liable for any damage, injury, or loss involving minors or passengers under your supervision.
6. ASSUMPTION OF RISK
Stand-up paddleboarding involves inherent risks including, but not limited to, falls, collisions, drowning, hypothermia, injury from wildlife, adverse weather, and currents. You voluntarily assume all such risks. You confirm that you:
Are physically capable of participating in water-based activities.
Can swim or are comfortable in open water.
Understand how to safely use all issued equipment.
Will wear your PFD at all times while on the water or as required by event staff.
Will follow all instructions from event organizers and staff.
Will not paddle under the influence of alcohol or any controlled substances.
7. WEATHER & CONDITIONS
Event organizers and staff reserve the right to modify, delay, or cancel paddling activities due to unsafe weather or water conditions. The participant agrees not to hold organizers or Hala Gear liable for any such decisions.
8. RETURN OF EQUIPMENT
All rental equipment must be returned to the designated return area at the conclusion of the event or upon request by event staff, whichever comes first. Equipment must be returned in clean condition. You agree to promptly report any damage or loss to event staff upon return. Failure to report known damage may result in additional liability.
9. RELEASE OF LIABILITY & INDEMNIFICATION
In consideration of being permitted to participate in the Witch Paddle event and use Hala Gear rental equipment, you, on behalf of yourself, your heirs, executors, administrators, and assigns, hereby release, waive, discharge, and agree to indemnify and hold harmless the event organizers, Hala Gear, their officers, employees, volunteers, and agents from any and all claims, actions, damages, liability, and expense arising out of or related to participation in this event and use of rental equipment, to the fullest extent permitted by law.
10. ACKNOWLEDGMENT & ELECTRONIC SIGNATURE
By submitting this form, I confirm that:
I have read this agreement in its entirety and understand its contents.
I am 18 years of age or older. If I am signing on behalf of a minor, I am the parent or legal guardian of that minor, I have the authority to enter into this agreement on their behalf, and I accept full financial and legal responsibility for them under the terms of this waiver.
I am a currently registered Witch Paddle participant.
I agree to all terms and conditions set forth in this waiver.
I accept full financial responsibility for any damage to or loss of rental equipment as described herein.
I voluntarily assume all risks associated with this activity.
If renting more than one board, I accept responsibility for all boards rented under this agreement on behalf of the additional participants listed, and confirm that each of them is a registered Witch Paddle participant.
I understand that my electronic submission constitutes a legally binding signature.

This waiver is governed by the laws of the state in which the Witch Paddle event takes place.
